The Spitzer housing team has stopped the final publication of the DHCR regulations that former Governor Pataki pushed through during the last weeks of his administration. And that means that the regulations do not exist!
The regulations that Pataki had put through on December 19, 2006 for the state's Division of Housing and Community Renewal would have- doubled the security for new rent stabilized tenants
- established a new ground for eviction: where a rent controlled tenant split the rent unevenly with a roommate
- made tenants liable for paying for lead paint removal, and
- permitted landlords to end rent stabilization in J-51 buildings (those getting tax breaks for repairs) based on the tenant's "high income."
The outgoing DHCR Commissioner refused to withdraw the proposed regulations
(with the exception of the 421a/J-51 section which they had already withdrawn). So Spitzer's new administration stopped the final publishing of these regulations in a victory for tenants.
