Legislation: New Proposed DHCR Regulations

A year and a half after the rent laws were amended in June 2011, the state's housing agency (DHCR) has proposed some new regulations to implement those changes.

Legislation: 2013 Bad Bill on J-51

The State Senate and Assembly have both now passed last June's "Big Ugly" combination bill, S3230, that includes - J-51 Tax breaks for owners
- 421-A and other tax breaks for specific (wealthy) developers,
- BUT NO significant protections for tenants.

Legislation: ML Co-operators Gain Victory in Highest Court
|
|
The state's highest court ruled in favor of Mitchell-Lama co-op residents at East Midtown Plaza.
It ruled that offering shares in a for-profit corporation to replace the existing Mitchell-Lama not-for-profit corporation was a big difference - and gave the NYS Attorney General discretionary power to refuse the offering plan - and therefore the development's removal ("privatization") from Mitchell-Lama.
Thomson Reuters reports "East Midtown Plaza Housing Company had argued that its privatization plan did not include the "offer or sale of securities" required under the state Martin Act, which gives the attorney general broad regulatory powers over securities transactions. East Midtown Plaza operates a six-building, 746-unit complex between 1st and 2nd avenues and 23rd and 25th streets."

Rent Controlled tenants are rent regulated tenants who live in buildings constructed before 1947. Their rent increases are determined by the State's Homes & Community Renewal agency - at rates generally higher than those of rent stabilized tenants.

Legislation: No rent laws while tenants wait
|
|
The NYS rent laws expired on June 15th. Until they are renewed, tenants are protected by their existing leases (or signed renewals) and the NYS Attorney General's office.
The Attorney General's website, http://nyshcr.org/ explains tenant rights during this period, and provides a hotline at (855) 391-4526, and at rentlaws2011@nyshcr.org.
In the meantime, take action to get stronger laws passed.

Legislation: Albany Caucus Asks Gov to Repeal Vacancy Decontrol
|
|
The NYS Black, Puerto Rican, Hispanic and Legislative Caucus wrote a letter to Governor Cuomo urging him to repeal vacancy decontrol.
The letter emphasizes the particular effect vacancy destabilization has on communities of color throughout New York.
